Terms of Service

These terms apply to all orders placed through the KEEP-THE-MOMENT website, web app, PWA and later app integrations.

KEEP-THE-MOMENT offers personalised physical products together with access to digital memories, upload features and frame links.

The exact scope of services follows from the relevant product description shown during the ordering process.

The presentation of products does not yet constitute a legally binding offer.

A contract is concluded once the order process has been completed and the order has been accepted or confirmed.

All prices are one-time payments. No subscription and no monthly fee apply.

Access to digital content is provided without recurring fees. Access is provided as long as the service is maintained.

Information on delivery times, shipping methods and any shipping charges is provided during checkout or in the relevant product information.

Partial deliveries remain reserved where reasonable for the customer.

The products are personalized and made to customer specifications. Therefore, the right of withdrawal does not apply.

The final wording of this clause should be legally reviewed against the actual production and checkout process before launch.

Customers may only upload content for which they hold the necessary rights and whose use does not infringe the rights of third parties.

Illegal, abusive, defamatory, infringing or otherwise unlawful content must not be uploaded.

Reasonable upload limits per memory may apply to protect quality, stability and fair use. The current limits are shown transparently inside the upload flow.

The customer remains responsible for the content uploaded by them.

KEEP-THE-MOMENT receives only those usage rights that are necessary to perform the contract, store, display, quality-check and produce the personalised product.

KEEP-THE-MOMENT may reject, block or remove content where legally required or necessary to protect legitimate interests.

The platform may only be used within its intended purpose and in compliance with applicable law.

Misuse, technical attacks or any unlawful use are prohibited.

KEEP-THE-MOMENT aims to keep the service available with as little interruption as possible but cannot guarantee uninterrupted availability at all times.

The provider reserves the right to further develop, adapt or change functions while taking legitimate interests into account.

Liability is governed by applicable law and is limited only to the extent permitted by law.

In cases of slight negligence, KEEP-THE-MOMENT is only liable for breaches of essential contractual obligations and limited to foreseeable typical damage.

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws require otherwise.
